Lawsuit Filed Over Charge For Public Records

WEST PALM BEACH, Fla. (AP) — A millionaire has filed lawsuits that challenge charges for a public record he requested from the Palm Beach County State Attorney’s Office.

In the lawsuits filed Tuesday, Marty O’Boye is challenging charges of $1.89 and $739.46. He told The Palm Beach Post ( ) he filed the charges to help the little guy.

Starting in December 2009, O’Boye made monthly requests for all DUI cases settled by the agency. He’s made 450 public records requests.

In May, O’Boye withdrew about 300 requests, but continued to ask for the DUI reports. The state attorney’s office estimated it would cost 30 cents to produce the records, with an additional $1.59 for 6.3 minutes of labor.

O’Boye argues the charges amount to an unlawful fee because it exceeds the “actual cost of duplication.”
