Update 9 a.m.
The Florida Commission on Ethics has voted this morning to drop ethics charges against Mayor John Marks.
Commissioners voted 6-1 to dismiss the case. Commissioner Matt Carlucci gave the only dissenting vote.
Marks did not attend the meeting. His attorney, Barry Richard of Tallahassee, said the mayor had surgery earlier this week and is resting at home.
