Advocate recommends fines, censure for Marks

The advocate for the Florida Commission on Ethics is recommending Tallahassee Mayor John Marks pay $30,000 in fines and face public censure and reprimand for alleged voting conflicts involving city vendors.

Marks’ attorney, however, is recommending that evidence in the case be found insufficient to establish that Marks violated the law.

Diane Guillemette, a senior assistant attorney general who acts as a prosecutor for the Ethics Commission, and Barry Richard, Marks’ attorney, filed their recommended orders earlier this month in the Marks case. Both sides are awaiting a final order by Administrative Law Judge Lawrence Stevenson, who presided over a one-day hearing in the case last month.

The Ethics Commission in June charged Marks with five counts of violating state ethics laws by voting on matters involving Honeywell, a client of the mayor’s former law firm, and the Alliance for Digital Equality, an Atlanta nonprofit that paid Marks as a member of its board of advisers.

Guillemette recommended that Marks be fined $6,000 for each of the five alleged violations, according to court records.
