When A Judge (and School) Lacks Discretion
Diane Tran, an 11th-grade honor student at Willis High School near Houston, was sent to jail for 24 hours last Wednesday by Judge Lanny Moriarty and ordered to pay a $100 fine for excessive truancy.
But that little tid-bit from the story does not tell the real story. Young Diane has an older brother at Texas A&M and younger sister. Where are the parents? Well, they divorced and skipped town. Apparently mom and dad went in two different directions and left the kids behind.
So, why was Diane missing some school? First of all she is an honors student taking AP classes and duel enrollment classes. She also works one full-time job and one part-time job in order to provide for her siblings.
Now we get to discretion or lack of it displayed by the Judge. The girl ended up spending 24 hours in jail with accused murders, prostitutes, etc. and made to pay a fine. He wanted to make an example of her:
“If you let one run loose, what are you gonna do with the rest of ‘em? Let them go too? A little stay in the jail for one night is not a death sentence.”
This Judge’s lack of discretion is frightening and he needs to spend some time in the pokey, perhaps removed from the bench. He had the chance to hold this young lady up as an example of overcoming remarkable hardships. But, he lacked the discretion. It makes you want to look at his other rulings, doesn’t it?

Addendum: The school, Willis High School in Houston, should have never ratted out the girl. Her brother graduated number 8 in his class; she wanted to do better. She is the type of student you brag about.

This is living proof that we in Texas elect the most stupid people to positions of power. This moron would make Vanna White look like a candidate for MENSA and is living proof that republican redneck bigots like Moriarty should not be allowed beyond The Kroger Shopper Center in Willis without a primary care-giver. Let them all run loose? I hope you read this Moriarty the Moron, and ask yourself if your own inbred offspring were as academically and financially responsible as the young person whose life you damned near ruined. If people were put on trial for blatant stupidity combined with insensitivity and intolerance you would be serving 3 life sentences without the possibility of parole. Maybe you could become a jail-house lawyer and finally learn something about reading the law. Unfortunately, you Moron, you can’t fix stupid. You need to resign or at least have the good taste not to run again. What an idiot.

Someone said that the school “ratted her out” but I must tell you being an educator that schools are required by law to report excessive absences (truancy) so please do not blame the school. They were only doing their job. Go after this despicable judge, and get him off the bench!!

Schools are “required” by law to report excessive absences and the judge is bound by the compulsory education laws to find her guilty of a misdemeanor BUT – somewhere along the line common sense has to kick in and special circumstances have to be taken into consideration. This is a girl holding down 2 jobs while taking college level courses, not some gang banger committing B&E’s. This is a classic case of robotic bureaucracy out of control. This judge should have his cases investigated after showing such a stunning lack of insight and compassion.
